Madge
S. Thorsen is a skilled mediator in commercial, construction
and family law disputes. Her ability to help people solve problems, manage
conflict and achieve results has been honed by years of diverse and sophisticated
civil litigation practice, from medical and pharmaceutical products liability
cases through trade secret, construction, employment, and many types of
contract disputes. She conducts private mediations as well as serves as
a mediator for the Institute for Alternative Dispute Resolution (Saint
Cloud State University); Minnesota Special Education Mediation Services;
and the US Postal Service REDRESS Program. She is also a firm and fair
arbitrator and on the Commercial, Construction and International Roster
of neutrals for the American Arbitration Association. She is a Qualified
Neutral under Minnesota Rule 114 (mediation, arbitration, family mediation).
Ms. Thorsen continues to represent business and commercial clients in
litigated disputes and to provide consulting services to other lawyers
and firms as a trusted independent counselor.
Richard
A. Kaplan has handled civil and criminal cases on both sides
of the fence. As an Assistant United States Attorney for the District
of Columbia, he investigated and tried felony cases including nearly 40
trials to jury verdict and a larger number of court trials. He has also
represented executives in grand jury investigations of alleged economic
crimes. On the civil side he has defended class actions brought under
RESPA, ERISA and various consumer fraud statutes; represented plaintiffs
and defendants in 10b-5 actions; both sides in intellectual property litigation
and handled expert witnesses on econometric and damages issues in securities
fraud class actions. In addition Mr. Kaplan has served in executive (non-legal)
positions for a Fortune 500 corporation and two of its subsidiaries and
has co-owned and operated a small importing and distribution business.
He is also a musician, avid golfer, and dog lover.
